Information about the Processing of Personal Data for Suppliers

Articles 13–14 of EU Regulation 2016/679

With regard to the processing of the personal data provided, we inform you that:

1. Controller and Data Protection Officer (DPO) for the processing

The data controller is the company ic! Berlin GmbH, Wolfener Str. 32 F, 12681 Berlin (hereinafter referred to as “the company” or “the data controller”).

2. Type of data processed, purpose and legal basis of the processing

Personal data of a general nature (contact details, first name, last name, personal information, position, email) of the supplier or the supplier’s personnel are collected and processed for pre-contractual purposes and for the execution of the contractual relationship, as well as for administrative, accounting, and tax obligations related to invoicing.
Email contacts may also be used – unless the recipient objects – to send commercial communications related to the contract.
The legal basis for data processing is therefore the fulfilment of contractual and legal obligations and, for the sending of commercial communications via email, the legitimate interest of the data controller pursuant to Article 130 of the Data Protection Act.

3. E-Mail Signature

Data protection notice pursuant to Art. 13, 14 GDPR:
In the context of our email communication, we process personal data that you provide to us (e.g. name, email address, telephone number). We use this data exclusively to handle your request and store it only as long as necessary for this purpose. No data is shared with third parties. The legal basis for processing is Article 6(1)(f) GDPR (legitimate interest) or, in the case of contract initiation or execution, Article 6(1)(b) GDPR.

Your rights:
You have the right to access (Art. 15 GDPR), rectification (Art. 16 GDPR), erasure (Art. 17 GDPR), restriction of processing (Art. 18 GDPR), data portability (Art. 20 GDPR), as well as objection to processing (Art. 21 GDPR). All requests for information, inquiries, revocations, or objections regarding data processing should be sent by email or via fax/post to Marcolin (Deutschland) GmbH, Waidmarkt 11a, 50676 Cologne, [email protected].
Furthermore, you have the right to lodge a complaint with the competent supervisory authority regarding data protection matters. The authority responsible for us is:
State Commissioner for Data Protection and Freedom of Information, Kavalleriestraße 2-4, 40213 Düsseldorf.

4. Disclosure of data to third parties – Recipients of the data

The company may disclose the data processed for the purposes mentioned above to the following recipients:

  • internal persons authorised to process the data within the company;
  • external persons belonging to the following categories: external consultants, service providers (transport, shipping, marketing and IT services, tax and credit services), the company’s sales network (agents), banking institutions, supervisory bodies and authorities;
  • other companies within the group.

5. Transfer of data to third countries

The processed data may be transferred to third countries. In the event of such a transfer, it will be carried out in compliance with the applicable regulations for the transfer of data to third countries.

6. Methods of data processing, duration and criteria for data retention

The data is processed in both paper and digital form and stored for the period necessary to fulfil the purposes mentioned above. Afterwards, it is retained for the applicable statutory limitation period concerning the retention of contracts and administrative data and/or for legal defence purposes, if required (ten years from the last use and/or interruption of the limitation period).
Data used for sending commercial communications will be retained until the consent of the data subject is withdrawn.

7. Provision of data

The provision of data is mandatory for the execution of the contractual relationship and for legal purposes. Failure to provide the data makes it impossible to pursue the purposes mentioned above. Processing for the sending of commercial communications is optional, and the data subject may object to this processing at any time.

8. Source of the data (only Art. 14 GDPR)

If we have not received your data directly from you, it originates from public sources (e.g. company websites, commercial registers) or has been provided to us by your company or other business partners.

9. Storage period

We store your data as long as it is necessary for the stated purposes and/or legal retention periods apply.

10. Rights of the data subject, withdrawal of consent and complaint to the supervisory authority

The data subject has the right at any time to request access to their personal data, correction, deletion, or restriction of processing, to object to the processing, and to exercise the right to data portability.
In any case, the data subject has the right to withdraw any given consent to data processing at any time, without affecting the lawfulness of processing based on consent before its withdrawal.
In the event of a suspected violation, the data subject also has the right, if the conditions are met, to file a complaint with a supervisory authority responsible for data processing in the EU member state where they normally reside, where they work, or where the suspected violation occurred.

11. Profiling and automated decision-making

The processing does not involve automated decision-making processes (e.g. profiling).
